By accessing or using AccessEU's website accessibility scanning service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
2. Description of Service
AccessEU provides automated website accessibility scanning and reporting services. Our Service analyzes web pages for compliance with Web Content Accessibility Guidelines (WCAG) 2.1 and European Accessibility Act (EAA) requirements.
The Service is provided for informational purposes only. While we strive for accuracy, automated scans cannot detect all accessibility issues, and results should be supplemented with manual testing and expert review.
3. User Responsibilities
When using our Service, you agree to:
- Provide accurate information when registering or submitting forms
- Only scan websites you own or have authorization to scan
- Not use the Service for any unlawful purpose
- Not attempt to interfere with or disrupt the Service
- Not reverse engineer or attempt to extract source code from the Service
4. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by AccessEU and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any content you submit for scanning. By using the Service, you grant us a limited license to process your content solely to provide the Service.
5. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The Service will be uninterrupted or error-free
- Scan results will be complete, accurate, or reliable
- The Service will meet your specific requirements
- Using our Service will ensure legal compliance
AccessEU does not provide legal advice. Our reports are technical assessments and should not be considered legal counsel regarding accessibility compliance.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCESSEU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits or revenue
- Loss of data
- Business interruption
- Legal fines or penalties
Our total liability for any claims arising from use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
7. Indemnification
You agree to indemnify and hold harmless AccessEU from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
8. Modifications to Service
We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may also update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
9. Termination
We may terminate or suspend your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in the EU member state where AccessEU is established.
